Oklahoma Cottage Food Label Requirements

Homemade Food Freedom Act — 2 O.S. §5-4.1 et seq., §5-4.3 as amended by HB 2975 (Laws 2024 ch. 16, eff. Nov 1, 2024); renamed Local Food Freedom Act by HB 3720 eff. Nov 1, 2026 (ODAFF Food Safety Division)

Registration

Not required

No licence, permit or inspection; production and sale are exempt from State Department of Health and ODAFF requirements (2 O.S. §5-4.3(A)). Optional ODAFF producer registration ($15 per year, valid one year from issue, mail-in form, no cash) gives a registration number that may replace the name, phone number and address on labels — ingredients, allergens and the legal statement must still be printed. Producers of TCS foods must first pass approved food-safety training (ServSafe Food Handler or OSU HFFA workshop) and may sell TCS foods only direct to the consumer.

Annual sales limit

$75,000 gross annual sales of prepared food ("home food establishment", 2 O.S. §5-4.2(1)); rises to $250,000 on Nov 1, 2026 (HB 3720)

Where you can sell

Non-TCS foods: direct to consumers in person or remotely (internet, telephone), or through a designated agent or third-party vendor (retail/grocery store, farm stand, farmers market, buying club, craft fair, flea market) that displays the required placard; delivery by the producer, agent, third-party vendor or parcel carrier; interstate shipping allowed if also labelled per federal law. TCS foods: direct producer-to-consumer sale and delivery only, after food-safety training (2 O.S. §5-4.3(A)(1)–(5), (7)). No meat, poultry, seafood, alcohol, unpasteurized milk or cannabis products.

The required label statement

This product was produced in a private residence that is exempt from government licensing and inspection.

Exact sentence in "legible print" (2 O.S. §5-4.3(A)(6)(f)); all required label information must be in a legible format of at least 10-point font (§5-4.3(B)). WORDING CHANGES ON NOV 1, 2026 (HB 3720, approved May 5, 2026): the sentence becomes "This product was produced in a private facility that is exempt from government licensing and inspection." — labels printed for use on or after that date should carry the new wording. Third-party vendors must display a placard with the longer disclosure "...This product may contain allergens." (§5-4.3(A)(1)(b)).

From 2026-11-01 the sentence becomes:

This product was produced in a private facility that is exempt from government licensing and inspection.

The builder switches to the new wording on that day. Enacted text.

  • Optional: an ODAFF registration number ($15/year) may be printed instead of the producer's name, phone number and physical address (§5-4.3(C))

Example: an Oklahoma label for a bag of butter cookies

An illustrative worksheet with the lines Oklahoma requires, and placeholders for your own details. It is not an approved product label or a tested recipe. Replace the ingredients and the measured package quantity with your actual product information.

Butter cookies

[Your business name]

[Your address, city, OK, ZIP]

Ingredients: Wheat flour [supplier sub-ingredients], sugar, butter [supplier sub-ingredients], eggs, salt.

Contains: Wheat, Milk, Eggs.

This product was produced in a private residence that is exempt from government licensing and inspection.

The example ingredient order follows the input weights in our butter-cookie recipe. It does not establish the weight of a finished bag. Any additions or supplier sub-ingredients must be reflected in your own label. The statement's size on this web page is not a print-size check; compare the printed label with the rule above.

Before you print

  1. Match every ingredient and sub-ingredient to your actual recipe and supplier labels.
  2. Check the allergen declaration, the filled package's net quantity, and producer details.
  3. Include the Oklahoma statement and check its size on the final printed label.
  4. Review the whole package, including any required information placed outside the Nutrition Facts panel.

Worth knowing

  • IMMINENT CHANGE: HB 3720 (approved by the Governor May 5, 2026, effective Nov 1, 2026) renames the Act the "Local Food Freedom Act", changes the required sentence from "private residence" to "private facility", redefines the business as a "local food establishment" at any location (including a residence, excluding restaurants), raises the sales cap to $250,000, and adds a local zoning/building-code compliance condition. Switch the statement wording on Nov 1, 2026.
  • Phone number is a required identity item on every label unless the whole name/phone/address block is replaced by the ODAFF registration number.
  • Net quantity is not in the state label list; federal rules apply to products shipped interstate (§5-4.3(A)(7)).
  • HB 2152 (2025), which would have raised the cap to $150,000, died in committee (last action Mar 4, 2025).
  • Sourcing caveat (2026-10-19): the OSCN codified statute page could not be fetched; the statute text was verified from the official enrolled bills on oklegislature.gov (HB 2975 ENR = current text; HB 3720 ENR = text from Nov 1, 2026).
